Contract nurses working in All India Institute of Medical Sciences will now be paid the minimum salary given to regular nurses along with dearness allowance. The system of equal pay for equal work will be implemented. The High Court said that the payment of salaries will be implemented with retrospective effect from September 19, 2016. The order should be complied with within 3 months.
While giving its judgment on the humanitarian service of nurses working in hospitals, the bench of Justice Vikameshwar and Justice Anup Kumar said that nurses render valuable humanitarian service as they assist the doctors and take personal care of the patients, hence such people should be given their dues. To be denied adequate compensation for service is a travesty of justice.
Demand for equal pay and benefits as regular staff nurses
Let us tell you that the appeal of contract nurses was being heard by the Delhi High Court. In which the 2016 order of the Central Administrative Tribunal was challenged. In this, the petition demanding equal pay and benefits as the regular staff nurses working in AIIMS was rejected. Delhi High Court has directed hospitals to give equal payment to nurses for equal work.
Citing the previous decision of the Supreme Court, the High Court said that in this case the petitioner is demanding the normalcy of the staff nurses working in AIIMS, who also do the work and have the same responsibilities. They cannot be denied adequate compensation. In such a situation, the nurses working on contract will be paid the same pay scale and dearness allowance as the regular staff nurses.
Payment within 3 months
The petitioner stated that she was initially appointed as a staff nurse on contract basis at a monthly salary of Rs 11750. Which was later increased to Rs 28000 whereas staff nurses working on regular basis are provided Rs 56800 per month. In this case, the hospital had claimed that the petitioner Sister Grade 2 was being paid at par with other contractual employees. In which there is no discrimination. However, now after the order of the High Court, the contract nurses will be paid the pay scale including dearness allowance with retrospective effect from 19 September 2016. Along with this, their salary will also be up to Rs 56800. Instructions have been given to ensure payment of all dues within 3 months.
